About these terms

This website is owned and operated by Manka India Design, a partnership firm, trading as “TOUCHE” (“we”, “us” or “our”). Our full business details are in our Legal notice.

By accessing or using this website, or placing an order, you agree to these Terms of service, together with our Privacy policy, Return and refund policy, and Shipping policy (the “Website Conditions”), and to all applicable laws. If you do not agree, please do not use the website.

We may update these terms from time to time. Updated terms apply to orders placed after the update is published. Please review this page periodically.

Who can order

You must be at least 18 years old to place an order. If you are under 18, please ask a parent or guardian to order for you.

Using the website

You agree to use this website only for lawful purposes and for your personal, non-commercial use. You must not:

copy, modify, distribute, or republish our content except as permitted by law or by us in writing,
use automated tools to scrape the website or collect data from it,
try to interfere with, disrupt, or gain unauthorized access to the website or its servers, or
provide false or misleading information when placing an order.

Orders and contract

Products shown on the website are an invitation to make an offer. Your order is an offer to buy. A contract is formed only when we send you an order confirmation email.

We may decline or cancel an order, for example because of stock unavailability, a pricing or description error, or suspected fraud. If we do, we will refund any amount you paid in full within 7 working days.

These terms are an electronic record under the Information Technology Act, 2000 and do not need a signature.

Prices and payment

All prices are in Indian Rupees (INR) and include applicable taxes unless stated otherwise. Any shipping or COD fees are shown at checkout before you pay. Prices may change at any time without notice, but the price shown at checkout for a confirmed order will not change. Prices for international orders may differ because of taxes, duties, and local laws.

Before you click “Payment Options”, please review your Order Summary (product, size, colour, and shipping address). You may apply a promotion code, discount code, or store credit, and can go back to make changes at any time.

Accepted payment methods: Credit Card, Debit Card, Net Banking, UPI, Wallets, and Cash on Delivery (COD). COD terms, including the advance and fee, are in our Shipping policy.

Payment authorization: There may be a short delay between your payment and confirmation from the bank to our payment gateway. If the issuing bank has downtime or a technical fault, your payment may be declined. In that case, our customer care team will contact you to help complete your order.

Product information

Most of our items are made to order and are made of fabric. Slight variations in weave, texture, colour, or print across items, or across parts of an item, are natural to the fabric and are not defects. Colours may look slightly different on your screen from the actual product.

Returns, refunds, and shipping

Cancellations, returns, exchanges, and refunds are covered in our Return and refund policy. Dispatch, delivery, and COD terms are covered in our Shipping policy. Both form part of these terms.

Limitation of liability

Your use of this website is at your own risk. We make no representation or warranty about the accuracy, completeness, or timeliness of information on this website, and exclude liability for inaccuracies or errors to the fullest extent permitted by law.

Nothing in these terms limits liability that cannot be excluded by law, including for fraud or death or personal injury caused by negligence, or your rights under the Consumer Protection Act, 2019. Subject to that, our total liability for any claim arising from an order is limited to the amount you paid for that order.

To the maximum extent permitted by law, we are not liable for:

decisions or actions taken in reliance on information on this website,
indirect, incidental, or consequential loss or damage connected with this website,
your misuse of the website or its content,
loss or alteration of information transmitted through the website,
technical problems or viruses arising from the website or its server,
products being unavailable at any time, or
your inability to access or use the website.

We do not guarantee that the website will always be available or free of faults, errors, interruptions, or unauthorized access.

Intellectual property

All content on this website, including trademarks, logos, prints, designs, text, and images, belongs to Manka India Design or its licensors and is protected by law. You may not use it without our prior written permission. More details are in our Legal notice.

Governing law and disputes

These terms are governed by the laws of India. All disputes arising out of or in connection with these terms, this website, or any order are subject to the exclusive jurisdiction of the courts at New Delhi.

General

Severability: If any part of these terms is found unenforceable, the rest remains in effect.
No waiver: Our not enforcing a right does not mean we give it up.
Force majeure: We are not responsible for delays or failures caused by events beyond our reasonable control.
Entire agreement: These terms, with the other Website Conditions, are the entire agreement between you and us about your use of this website and your orders.
Notices: We may send notices to the email address you provide with your order.
